== Pre-trial proceedings == The first evidence that the prosecution introduced against Agüero, was immediately after her arrest, alleging that Agüero was behind every case, both deaths and decompensations, and that Agüero herself was in the place of the incidents, further alleging that she was the one who notified the doctors and other medical personnel that an emergency with a newborn was underway. On the same day that the prosecution introduced their first accusation, the court in charge of the pre-trial procedures, ordered psychiatric and psychological evaluations of Agüero, to later dictate pre-trial detention. In January 2023, the psychiatric evaluators determined that Agüero knows right from wrong and that she does not suffer from any mental disorder. After the evaluation, Agüero's indictment was confirmed. The prosecution alleged that in November 2021, Agüero searched on Google "how to dose potassium and insulin injections in newborns." Agüero denied that she searched "how to apply potassium injections" on Google and alleged that she does not have the knowledge to perform such a procedure. Another accusation argued that Agüero concealed the syringes with which she allegedly injected the babies with potassium, under her sleeves, with other medical personnel noting that she went to work with long-sleeved shirts even on hot summer days.

==== Adequacy of equipment and regulations ==== The factory was not well equipped to handle the gas created by the sudden addition of water to the MIC tank. The MIC tank alarms had not been working for four years and there was only one manual back-up system, compared to a four-stage system used in the United States. The flare tower and several vent gas scrubbers had been out of service for five months before the disaster. Only one gas scrubber was operating: it could not treat such a large amount of MIC with sodium hydroxide (caustic soda), which would have brought the concentration down to a safe level. The flare tower could only handle a quarter of the gas that leaked in 1984, and moreover it was out of order at the time of the accident. To reduce energy costs, the refrigeration system was idle. The MIC was kept at 20 degrees Celsius, not the 4.5 degrees advised by the manual. Even the steam boiler, intended to clean the pipes, was non-operational for unknown reasons. Slip-blind plates that would have prevented water from pipes being cleaned from leaking into the MIC tanks if the valves had been faulty were not installed and their installation had been omitted from the cleaning checklist. As MIC is water-soluble, deluge guns were in place to contain escaping gases from the stack. The water pressure was too weak for the guns to spray high enough to reach the gas which would have reduced the concentration of escaping gas significantly. In addition to it, carbon steel valves were used at the factory, even though they were known to corrode when exposed to acid.

=== Pharmacokinetics === Topilutamide is a topical medication and is applied to the scalp. Topilutamide degrades in human serum at 37 °C with a half-life of approximately 6 hours and is undetectable after 48 hours. Perfluoroacylamido-arylpropanamides decompose hydrolytically to BP-34 and their corresponding perfluorocarboxylic acid. In the case of topilutamide, that perfluorocarboxylic acid is trifluoroacetic acid. The two metabolites of topilutamide namely BP-34 and trifluoroacetic acid were undetectable in human serum (below the detection limit of 5 ng/mL) along with the parent compound topilutamide, in human studies. === Removal of additives === In 2011, food blogger and activist Vani Hari noted that Chick-fil-A sandwiches contained nearly 100 ingredients, including peanut oil preserved with tert-butylhydroquinone (TBHQ), made from butane. In October 2012, Chick-fil-A invited Hari to meet with company executives at its headquarters. In December 2013, Chick-fil-A said that it was removing high-fructose corn syrup and artificial dyes, and was testing a new peanut oil. Like other companies, Chick-fil-A does not publicly announce such changes unless already in the news, because it focuses on these ingredients.
